FLSA amendments to become effective in April

The 1985 amendments to the Fair Labor Standards Act (FLSA) have been signed by President Ronald Reagan and will take effect April 15.
The compromise bill, S.1570, is the result of a joint Congressional conference committee, which ironed out minor differences in two versions that were passed separately by the U.S. House of Representatives and the U.S. Senate.
The amendments state that certain public agency employees can receive compensatory time off instead of being paid for their overtime work (at the rate of time and a half). The legislation also clarifies the application of the FLSA to volunteers.
The bill says those employed in public safety (firefighters, police officers, etc.), emergency response, or seasonal activity, may accrue up to 480 hours of compensatory time for hours worked. Workers who perform other functions may accrue only 240 hours of compensatory time.
Employees who surpass the maximum number of “comp time” hours for their job must receive overtime pay for additional hours worked.
The Department of Labor will issue regulations for implementing the amendments before April 15.
